Hazarika, learned Standing Counsel, Revenue and Disaster Management Department for the respondent no. 1; Mr. J. Handique, learned Junior Government Advocate, Assam for the respondent nos. 2 & 3. 2.
In view of the limited nature of relief sought for by the learned counsel for the petitioner, this writ petition is taken up for consideration in the motion stage itself, as agreed to by the learned counsel for the parties. Page No.# 11/13
3. The petitioners, 127 in nos., have claimed that they are residents of Kendua, Sahan, Joyantipur and Patrapur villages, Mouza – Karara, Revenue Circle – Kamalpur, District – Kamrup [R]. The petitioners claimed that in view of their long occupancy and possession of different parcels of land, Khatians were issued in their favour. Despite long standing claims for issuance of patta, the District Revenue Authorities have not yet issued pattas to the petitioners. 4. The petitioners have approached this Court aggrieved by issuance of a notice dated 04.03.2025 the respondent no. 3 to some of the petitioners asking for their presence for the purpose of demarcating the parcels of land mentioned in the notice. 5. The learned counsel for the petitioners by referring to the Notice dated 04.03.2025 has submitted that a demarcation proceeding, registered as Boundary Case no. 68, is at the instance of the respondent no. 4. According to the petitioners, some of the parcels of land indicated in the Notice dated 04.03.2025 are in the occupation of some of the petitioners. On perusal of the contents of the notice, it is noticed that different dag nos. under patta no. 6 of Village – Kendua, Mouza – Karana are mentioned in the notice and the notices were asked to be present on a scheduled date. After learning about the Notice dated 04.03.2025, the petitioners made an application before the respondent no. 2 requesting to furnish them a copy of the application, submitted by the respondent no. 4, which led to registration of Boundary Case no. 68.
The petitioners are in apprehension that prior to issuance of pattas in their favour, if the demarcation proceeding is concluded, the same might prejudice their rights
Page No.# 12/13 to claim periodic pattas on the strength of the Khatians. 6. Mr. Laskar, learned counsel for the petitioners has submitted that if the copy of the application submitted by the respondent no. 4 is furnished to the petitioners then they can submit objections/representations in a better manner highlighting their genuine grievances and apprehensions. 7. Mr. Handique, learned Junior Government Advocate has submitted that if the petitioners who are claiming possession of lands within Kendua village, require a copy of the application which led to registration of Boundary Case no. 68, then the same can be provided within a reasonable time period so as to enable those petitioners who have claimed certain rights with regard to the parcels of land mentioned in Notice dated 04.03.2025, to submit their objections/representations. 8. Having regard to the limited nature of direction sought for in the afore- stated manner and as agreed to by the learned State Counsel, this writ petition is disposed of with a direction to the respondent no. 2 to furnish a copy of the application which led to registration of Boundary Case no. 68, to a representative of those petitioners who are claiming to be in possession of parcels of lands of Village – Kendua within a period of 15 days from the date of submission of a certified copy of this order by the petitioners at his office. 9. After receipt of the application pertaining to Boundary Case no. 68, those petitioners can submit their objections/representations within a period of 15 days from the date of receipt of the copy of the application before the
Page No.# 13/13 respondent no. 2, who in turn, shall give consideration to such objections/representations. It is observed that in Boundary Case no. 68, the respondent no.
4 is to be given an opportunity of hearing during the demarcation proceedings and this order of furnishing a copy of the application is not going to cause any prejudice, this writ petition is disposed dispensing with the process of issuance of a notice to the respondent no. 4. 10. With the observations made and directions given above, this writ petition is disposed of. No order as to cost. JUDGE Comparing Assistant
