The instant petition has been preferred with the following prayer:- "(A) direct the Principal Judge, Family Court, Kushinagar place Padrauna to decide the recall application no. 982 of 2024 dated 09.10.2024 (Vishal Kumar Gupta vs. Smt. Shivani Gupta) under Section 145 B.N.S.S. which is pending in the court of Principal Judge, Family Court Kushinagar place Padrauna, expeditiously within a stipulated period." 3. Learned counsel for the petitioner submitted that grievance of petitioner would be sufficiently met in case the aforesaid recall application no. 982 of 2024 be decided expeditiously. 4. Learned AGA vehemently opposed the prayer sought through the instant petition. 5. Be that as it may, without interfering into the merits of the matter, if there is no other legal impediment, learned Principal Judge, Family Court, Kushinagar place Padrauna is hereby directed to decide the recall application no. 982 of 2024 dated 09.10.2024 (Vishal Kumar Gupta vs. Smt. Shivani Gupta) under Section 145 B.N.S.S. as expeditiously as possible preferably within a period of 4 months from the date of presentation of a certified copy of this order before him without granting any unnecessary adjournment to either of the parties unless the same is unavoidable but after giving full opportunity of hearing to both sides. It is also made clear that both the parties shall render their full cooperation for expeditious disposal of the said case. 6. The instant petition stands disposed of accordingly.
