The present application has been filed by the petitioner for restoration of Cr. Misc. No. 87628 of 2024 which was dismissed for non-compliance of the order dated 08.01.2025 wherein two weeks peremptory time was granted for taking steps for service of notice upon the O.P. No.2 under both modes i.e. under ordinary process and registered cover with A/d within a period of two weeks. 3. Learned counsel for the petitioner submits that Patna High Court CR. MISC. No.16354 of 2025(2) dt.05-03-2025 2/2 unfortunately due to inadvertence or misconception of dates by the Office of the counsel, the requisite could not be filed within two weeks i.e. till 22.01.2024 though the order of the Hon’ble Court for filing necessary requisites has been substantially complied with on 20.02.2025. 4. For the reasons stated in this restoration application and the submissions made in support thereof, the present application is allowed and, as a consequence, the Cr. Misc.
