The present writ petition has been filed for issuance of direction upon the Deputy Commissioner, Gumla (the respondent no. 3) to take required steps for payment of compensation to the petitioner for death of her husband – Mahanand Kamar @ Mahanad Kamar, occurred while he was deployed as Polling Officer on 27.05.2022 in Girls High School, Palkot (Polling Booth No. 66).

Learned counsel for the petitioner submits that the petitioner’s husband was deployed as Polling Officer during Panchayat Election, 2022 for conducting election of the Member/Mukhiya of Gram Panchayat, Member of Panchayat Samiti, Palkot, Member of Zila Parishad, Palkot, District- Gumla. A copy of order of appointment of Presiding/Polling Officers issued on 20.05.2022 has been annexed as Annexure-1 to the present writ petition.

3. It is further submitted that while the petitioner’s husband was on election duty on 27.05.2022, he fell ill whereafter he was taken to hospital, however he died during the treatment. Thereafter, the petitioner filed representation before the respondent no. 3 seeking compensation for death of her husband, which was received in the office of the said respondent on 26.05.2023. A copy of the said representation has been annexed as Annexure-3 to the present writ petition. The petitioner, thereafter, also gave few reminders in this regard, however no action was taken by the respondent no. 3 which has compelled the petitioner to prefer the present writ petition.

Having heard learned counsel for the parties and considering the nature of prayer made by the petitioner in the present writ petition as well as that Annexure-3 (the petitioner’s representation) bears receiving by the office of the respondent no. 3, the said respondent is directed to take up the petitioner’s representation and to take an appropriate decision in this regard within two months from the date of receipt/production of a copy of this order.
5. The writ petition is accordingly disposed of with aforesaid direction.
