Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased tomay be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in non-payment of compensation along with other benefits, for acquiring the petitioner's land to an extent of Ac.01- 45 cents in Sy.No.48/3A and Ac.03-25 cents in Sy.No.48/3B, situated at Kilakipodu Village, Vijalapuram Gram Panchayath, Ramakuppam Mandal, Chittoor District, under Land Acquisition for Air strip and development of Green Field Airport at Kuppam, as illegal, arbitrary and violation of principles of natural justice and in violation of Rules and Regulations contemplated there under consequently direct the respondents to pay the compensation along with other benefits to the petitioner, for acquiring the petitioners land to an extent of Ac.01-45 cents in Sy.No.48/3A and Ac.03-25 cents in Sy.No.48/3B, situated at Kilakipodu Village, Vijalapuram Gram Panchayath, Ramakuppam Mandal, Chittoor District, and to pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to direct the respondents not to disburse the« compensation amount to the 6*^ respondent or any third parties in respect of the petitioner's land to an extent of Ac.01-45 cents in Sy.No.48/3A & Ac.03-25 cents in Sy.No.48/3B, situated at Kilakipodu Village, Vijalapuram Gram Panchayath, Ramakuppam Mandal, Chittoor District, pending disposal of the main writ petition and to pas Counsel for the Petitioner:

Narasimha Rao, learned counsel for the petitioner and Sri Divya Teja, learned Assistant Government Pleader for respondents 1 to 4. 2. Notice to respondent No.6 is dispensed with since no adverse order affecting her right or interest is passed. 3.
Learned counsel for the petitioner would submit that the petitioner is the absolute owner and possessor of an extent of Ac.01-45 cents and Ac.03-25 of land in survey Nos.48/3A and 48/3B, respectively, of Kilakipodu Village, Vijalapuram Gram Panchayat, Ramakuppam Mandal, Chittoor District. An extent of Ac.483.83 cents of land in Ramakuppam and Santhipuram Mandals was sought to be acquired for the construction of the administrative Air Strip, Kuppam.

He would submit that in the letter addressed by the District Collector vide Roc.No.G5/5104/2015 dated 05.06.2025 (Ex.P4) to respondent No.5, regarding the payment of compensation, the name of respondent No.6 is shown at serial Nos.59 and 60 in respect of the subject property. Learned counsel for the petitioner would submit that litigation is pending between the petitioner on one side and respondent No.6 on the other side. The petitioner issued a legal notice dated 30.06.2025 (Ex.P6) to the respondents 2 to 4, requesting not to disburse the amount to the third parties. However, no orders are passed. Hence, the writ petition.

Learned Assistant Government Pleader for Revenue, on instructions, while not disputing about the notice (Ex.P6) issued by the petitioner, would contend that respondent No.3 will consider the petitioner’s representation and legal notice dated 30.06.2025 and pass appropriate orders regarding disbursement of compensation in respect of the aforementioned lands.
6. Given the above facts and circumstances of the case, this writ petition is
disposed of at the admission stage with the consent of learned counsel on

either side directing respondent No.3 to consider the legal notice dated 30.06.2025 issued by the petitioner regarding payment of compensation in respect of the aforementioned lands and pass appropriate orders as per law, before disbursing the amount concerning the above mentioned lands. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
