Page No.# 2/3 BNS, 2023. 3. The allegation stated in the FIR is that the informant/victim was in a love relationship with the present petitioner and had maintained a physical relationship with the petitioner upon the promise to marry her. Subsequently, the love relationship ended and the petitioner, who had recorded some obscene photos and videos of the informant/victim, made the same viral though social media such as facebook and instagram. 4. On perusal of the Case Diary, it appears that the version of the informant is contradictory to what she had stated in the FIR, in as much as she stated that the accused had forcefully married her by conducting court marriage at Barpeta. Therefore, prima facie it appears that Section 69 BNS, 2023 may not be attracted in the facts of the present case. As far as uploading of obscene photos and videos of the informant/victim is concerned, which should attract Section 67 of the IT Act, the instant case has not been registered under the same Section and there is nothing available in the Case Diary either, with regard to such viral photos and videos of the informant/victim. 5. Considering the above, the prayer for pre-arrest bail is allowed. 1. The above named accused/petitioner, in the event of his arrest in connection with this case, shall be released on pre-arrest bail on furnishing a bail bond of Rs. 50,000/- with 1(one) local surety of like amount to the satisfaction of the arresting authority, in connection with the aforesaid case. 2.
It is further provided that the petitioner shall cooperate with the investigation. 6. Bail petition stands disposed of. JUDGE
