GUNESHWAR SHARMA ORDER (Oral) 10.12.2025 [1] Present Mr. N. Ibotombi, learned sr. counsel assisted by Ms. Y. Jinita, learned counsel for the petitioners, Mr. P. Tamphamani, learned counsel appearing physically and Mr. Ramneek Mishra, learned counsel appearing on VC for the respondent nos. 1 & 2 i.e. Cycling Federation of India (CFI) and Mr. Kh. Tarunkumar, learned sr. counsel assisted by Mr. W. Jamon, learned counsel on behalf of the respondent no. 3 i.e. Manipur Cycling Association (MCA). [2] The present writ petition has been filed by the writ petitioners and representatives of 29 players listed in Annexure-A/6 of the writ petition for allowing them to participate in the 77th Senior, 54th Junior and 40th Sub-Junior National Track Cycling Championship to be held at Rudrapur, Uttarakhand from 19.12.2025 to 23.12.2025. It may be noted that the Manipur team for the said Uttarakhand meet has already been selected by MCA on the basis of 4th Governor’s Cup tournament conducted in November, 2025 and the team has already been sent by an order dated 02.12.2025 passed by this Court in W.P. (C) No. 946 of 2025. The plea of the present 29 players is that since they are in various cycling academy established by Sports Authority of India (SAI) at different parts of India and due to the lack of information they could not participate in 4th Governor’s Cup. Ibotombi, learned sr. counsel for the petitioners has pointed out that these 29 players are medalist in various tournament and they are trained by the SAI. Keeping in view of training for Olympic and other international tournament, it is submitted that as an exception these 29 players may be permitted to participate in the coming Uttarakhand Meet as mentioned above. [4] Mr. Ramneek Mishra, learned counsel for the CFI has pointed out that Manipur team consisting of 16 players and 3 officials have already been submitted by MCA and the same has been approved by this Court vide order dated 02.12.2025 passed by this Court in W.P. (C) No. 946 of 2025. When the matter was listed yesterday, Mr. Kh. Tarunkumar, learned sr. counsel for the MCA submits that it would not be possible for the association to conduct a fresh trial for the players staying at different locations all over the country. In the circumstances, this Court suggested to the learned counsel for the CFI for conducting a fresh trial selection for these 29 players by CFI in association with SAI and the learned counsel for the CFI prayed for 1(one) day time to take instructions in this regard. [5] Today, when the matter is taken up, Mr. Ramneek Mishra, learned counsel for the CFI has informed that vide letter dated 25.11.2025, the CFI requested to the MOA to conduct a trial selection for Manipur team to be participated in the Uttarakhand Meet which is to be held from 19.12.2025 to 23.12.2025. In response to the request of CFI, the MOA issued an another notification dated 27.11.2025 intimating all concerned to participate in the trial selection to be conducted on 30.11.2025 for selecting Manipur team for the Uttarakhand Meet. It is also submitted that these 29 players listed in Annexure- A/6 participated in the trial selection conducted by MOA under the aegis of CFI and they have been approved for participation. It is suggested that instead of conducting a fresh trial, the players approved in the trial conducted by MOA on 30.11.2025 may be considered, keeping in mind the urgency involved and shortage of time for conducting a fresh trial selection. [6] Mr. Kh. Tarunkumar, learned sr. counsel for the MCA has submitted that the association has challenged the notification dated 27.11.2025 issued by MOA on the request of CFI to conduct a trial selection for Manipur team by way of writ petition being W.P. (C) No. 946 of 2025. Upon the withdrawal of the request dated 25.11.2025 by CFI vide letter dated 01.12.2025, the said writ petition was disposed of on 02.12.2025 approving the Manipur team selected on the basis of the 4th Governor Cup performance conducted by MCA. [7] It was also recorded in the order dated 02.12.2025, the objection for the learned counsel for the CFI that the 4th Governor Cup tournament was not intimated to the CFI and the same was not in consonance with the constitution of the CFI. However, this Court allowed the team selected on the basis of the 4th Governor Cup by observing that in future, all the tournaments and trial selections to be conducted by MCA after duly intimated to CFI in advance and CFI will depute the authorized person to oversee the tournament and selection. In the circumstances, the team selected by MCA consisting of 16 members and 3 official has already been forwarded to the CFI for the Uttarakhand Meet. [8] As already stated above, the intimation letter dated 25.11.2025 issued by CFI to MOA for holding a trial selection, has already been withdrawn vide letter dated 01.12.2025. It is a fact that there was a trial selection on 30.11.2025 conducted by MOA at the request of the CFI. Keeping in mind the time constraints and the efforts of conducting a trial selection for the players at various SAI centres all over India, the result of trial selection done on 30.11.2025 can be relied for a limited purpose. [9] This Court is of the view that the 29 players selected in the trial selection conducted by MOA on 30.11.2025 may be considered for sending additional team from Manipur in addition to the team already sent by MCA. This Court is conscious of the fact that the intimation dated 25.11.2025 issued by CFI requesting MOA to conduct a selection trial for Manipur team was subsequently withdrawal by letter dated 01.12.2025. Without going to the merit of the request and especially order dated 02.12.2025 passed by this Court in W.P. (C) No. 946 of 2025, this Court intends to use the result of the trial selection conducted on 30.11.2025 to overcome the difficulty of holding another trial. Page 4 of 6 [10] This Court has considered the trial selection conducted on 30.11.2025 for the limited purpose of identifying the eligibility for the 29 players listed at Annexure-A/6 of the writ petition and the same does not amount to revival of the letter dated 25.11.2025 issued by CFI and revocation order dated 01.12.2025 and the same is not derogation of order dated 02.12.2025 passed by this Court in W.P. (C) No. 946 of 2025. [11] In the conclusion, keeping in view of the peculiar facts and circumstances of the case, this Court approves the 29 players listed in Annexure- A/6 who have already participated and approved in the trial selection conducted by MOA on 30.11.2025 and 2(two) Technician namely, (i) Mr. Usham Ashok Singh and (ii) Mr. Yumnam Meghachandra Singh as additional team from Manipur in addition to the already sent 16 members team by the MCA by extending the last date for submissions. [14] Registry is directed to furnish a copy of this order to the learned counsel appearing on behalf of the CFI and the same shall be considered as submission of additional team from Manipur without requiring any further endorsement from any authority and the CFI is requested to take special care for the Manipur team in view of the increased number of participants. The digitally signed copy of this order be given to the learned counsel for CFI in the course of the day by Whatsapp. [15] Before concluding, this Court expresses it appreciation to the efforts made by the leaned counsel appearing for the parties especially, Mr. Ramneek Mishra, learned counsel appearing on behalf of the CFI for enabling additional team from Manipur to participate in the Uttarakhand meet as a special case, keeping the interest of players. [16] With these observations, the W.P. (C) No. 966 of 2025 is disposed of.
