Order on Board 06.03.2025
1. Learned counsel for the petitioner would submit that an award was passed on 29.04.2024 by the Chhattisgarh State Industrial Court, whereby the late Mahendra Singh Atram was reinstated in service without back-wages. He would contend that on 6.8.2024, it was informed by the counsel appearing for respondent No.1 that SMT NIRMALA RAO
-2- Mahendra Singh Atram is no more and his legal representatives were brought on record. He would fairly contend that as an award was passed by the learned Labour Court with regard to reinstatement only and the employee is no longer alive, no order can be passed in his favour.
2. On the other hand, learned counsel for respondent No.1 would oppose the submissions made by counsel for the petitioner. He would submit that the legal heirs may claim retiral or terminal benefits in the present petition.
3. Heard learned counsel for the parties and perused the documents present on the record.
4. An award was passed in favour of respondent No.1 whereby he was reinstated without back-wages. He expired on 20.4.2021, and his legal representatives were brought on record. As the award is confined to reinstatement in favour of late Mahendra Singh Atram, and after his death, the award passed by the learned Labour Court cannot be executed against the petitioner, therefore, in the opinion of this Court, the petition has become infructuous and consequently, the same is hereby dismissed. With regard to the terminal benefits or retiral dues, the legal representatives of respondent No.1 would be at liberty to take recourse to the law.
5. Consequently, the petition is dismissed being rendered infructuous. Sd/-
