That applicant has filed the present application under Section 419 (4) of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 for grant of permission to file the appeal. It was laid down by Hon’ble Supreme Court in Joseph Stephen and others Versus Santhanasamy and others 2022 LiveLaw (SC) 83 that the victim is not required any permission to file appeal under Section 372 of Cr.P.C. which corresponds to Section 413 of BNSS. Therefore, the present application is dismissed as infructuous. Cr.Appeal No. of 2025 (CRAST No.11107 of 2024) Copy of the appeal stands supplied to the learned counsel for respondent No.1. Since, application bearing Cr.MP(M) No. 2376 of 2024 has been dismissed as infructuous, therefore, the appeal be registered. Learned counsel for the appellant submits that another appeal bearing Cr.Appeal No. 677 of 2024 has been filed pertaining to the same F.I.R. List the present matter with Cr.Appeal No. 677 of 2024.
