THIS PETITION, COMING ON FOR REPORT SETTLEMENT, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner has sought for the following relief:- “ Wherefore the Petitioner humbly prays that this Hon’ble Court may be pleased to quash the Final Report/ Charge Sheet in C.C.No. 8156/2023 dated: 31.03.2023, for the offences punishable under Sections 120B, 420, 417, 506 read with Section 34 of the Indian Penal Code, 1860 produced at Document No.1, pending on the file of the Hon’ble chief Metropolitan Magistrate, Bengaluru, in the interest of justice and equity.” 2. Learned counsel for the petitioner – accused and learned counsel for respondent No.2 – complainant have filed a Joint Memo dated 07.02.2025 duly signed by them and the same is taken on record. 3. Petitioner – accused appeared through video conferencing and her counsel and respondent No.2-complainant and counsel for respondent No.2 are physically present before the - 3 - NC: 2025:KHC:5906 CRL.P No. 4581 of 2023 Court and they admit the contents of the Joint Memo, which reads as under:- “The above petition is filed seeking challenge to the final report in CC 8156/2023 filed by Respondent No.2 for the offences allegedly committed by her under Sections 120B, 420, 417, 506 read with Section 34 of Indian Penal Code, 1860. In pursuance to the staying of the above proceedings, the Petitioner and Respondent No.2 have entered into compromise in C.P. No. 311/202 C/W C.P. 310/2024 and in terms of which the marriage solemnized between the Petitioner and Respondent No.2 stood dissolved. The said compromise is reported before the Family Court at Bagalkot in M.C. No. 157/2023. In terms of the compromise entered into between the Petitioner and Respondent No.2 and both of them have agreed to compromise the above matter and the Respondent No.2 has agreed not to proceed in the matter in respect of the charge sheet. In terms of the above, Petitioner and Respondent No.2 prays that his Hon’ble Court may be pleased to allow the above petition and quash the impugned final order/charge sheet in filed C.C. 311/2024 pending on the file Principal Judge, Family Court, Bagalkot in the interest of justice and equity.” 4. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following: - 4 - NC: 2025:KHC:5906 CRL.P No. 4581 of 2023 ORDER (i) The petition is disposed of in terms of Joint Memo dated 07.02.2025. (ii) The proceedings in C.C.No.8156/2023 (arising out of Crime No.40/2023 of 1st respondent – Police) registered for the offences punishable under Sections 120B, 420, 417, 506 r/w. Section 34 of IPC, pending on the file of the Chief Metropolitan Magistrate, Bengaluru, insofar as the petitioner is concerned are hereby quashed.
