Heard Mr. NK Murry, learned counsel for the petitioner. This writ petition is filed by the petitioner being aggrieved by the pendency of an appeal before the Appellate Authority. An appeal was filed by the writ petitioner against the order of suspension dated 03.05.2025 issued by the respondent no.3. The petitioner was appointed as a Sarkari Gaonburah (SGB) on 30.11.2006 of Uttar Borbil Sl. No.1. By an order passed by the respondent
Page No.# 3/4 no.3, the petitioner was suspended by an order dated 03.05.2025 which the petitioner claims to have received on 10.05.2025. By the said order, the petitioner was suspended from the post of Sarkari Gaonburah (SGB) due to misconduct in his duty. Being aggrieved, the petitioner filed an appeal being Appeal No.167/2025 before the Appellate Authority, namely, the Director of Land Records and Survey. The limited grievance of the writ petitioner before this Court is that although the appeal has been filed and duly received and numbered, the Appellate Authority has not passed any effective orders and the matter is still pending. Mr.
J Handique, learned Standing Counsel, Revenue Department and Ms. S . Kemprai, learned counsel for the respondent nos. 2 to 5 submits that as per the instructions received, the matter is being considered by the Appellate Authority and the date of hearing is likely to be fixed shortly. Considering the submissions made by the learned counsel for the parties, and as agreed to by the learned counsel for the parties, this Court is of the view that at this stage, considering that the appeal has been filed by the writ petitioner and the same is pending before the Appellate Authority, ends of justice will be met if the Appellate Authority is directed to dispose of the appeal filed by the writ petitioner as per the provisions of law within a period of 90 (ninety) days from the date of receipt of a certified copy of this order. Any such order passed
Page No.# 4/4 by the Appellate Authority, copies thereof shall be served on the writ petitioner. The Appellate Authority will permit the writ petitioner to examine the records available before the Appellate Court in connection with the appeal and file necessary pleadings, if permitted in law. With the above observations, the writ petition shall stands disposed of at this stage without issuing any notice. JUDGE Comparing Assistant
