This Contempt petition has been preferred by the applicant under Article 215 of the Constitution of India read with Section 12 of the Contempt of Courts Act,1971 for non-compliance of the order dated 13.09.2024 passed in WP(S) No.5697/2024. 2. In WP(S) No.5697/2024, this Court has passed the following order on 13.09.2024, annexed as Annexure-C/1:- “It is directed that the petitioner’s present place of posting shall not be disturbed till the next date of hearing. List this case in the week commencing 11th November, 2024.” 2 3. Learned counsel for the applicant would submit that on 12.11.2024 aforesaid writ petition was called for hearing and interim protection was extended till the next date of hearing. He further submits that stay order was passed in favour of the applicant, despite that, non-applicant (herein) is compelling Collector, Kabirdham (C.G.) to relieve the applicant from the present place of posting and he also made communication vide Annexure-C/3 dated 03.01.2025 in this regard. 4. When specific question was posed to the counsel for the applicant that whether present place of posting of applicant has been disturbed by respondent authorities or not, then he submit that it has not been disturbed, as stay order was granted by this Court on 13.09.2024 and further extended on 12.11.2024 in favour of the applicant, the same is still in existence. 5. Having considered the fact that present place of posting of applicant has not been disturbed, as the stay order was granted in favour of the applicant and was further extended, by this Court. Thus, no case of contempt is made, as such I do not find any reason to proceed further in the matter, initiating contempt proceeding against the respondent. 6. However, applicant may inform respondent (herein)/Chhattisgarh Infrastructure Development Corporation (CIDC) Ltd. about the stay order passed by this Court. 7. Accordingly, contempt case is dropped.
