1. Heard Mr. S. Ahmed, learned counsel for the petitioner. Also heard Mr. R.J. Baruah , learned Additional Public Prosecutor for the State. Page No.# 2/3

This application under Section 483 of BNSS, 2023 has been filed by the petitioner, namely, Najrul Islam, has prayed for grant of bail in connection with Nagaon P.S Case No. 796/2025 registered under Sections 61(2)/316(5) of BNS. 3. The allegation as reflected in the FIR is that on 08.10.2025, the Additional District Commissioner (Education), Nagaon had lodged an FIR before the Senior Superintendent of Police Station, Nagaon making allegations of corruption and malpractice against the main accused one Pallabi Saikia DQM, in the recruitment process of the education volunteers under Laokhowa Education Block. Hence, the case. 4. The Case Diary, which has been called for in connection with another application, is available with learned Addl. Public Prosecutor. 5. Upon perusal of the said Case Diary by learned Addl. Public Prosecutor, it is submitted that there are allegations against the present petitioner upon collecting some money from educational volunteers for the purpose of purchasing educational materials, although the same are supplied by the government. 6. The petitioner has already spent 53 days in custody and the investigation would have progressed by now. 7. Having regard to the above and to the nature of the allegations as well as the fact that main accused has been granted interim pre-arrest bail vide order dated 10.11.2025 in AB No. 2640 of 2025, the above named petitioner shall be released on bail of Rs. Page No.# 3/3 50,000/- with 1(one) surety of the like amount to the satisfaction of the concerned learned Court. 8. It is further provided that the petitioner : i) shall not abscond. (ii) shall be available for trial. (iii) shall not hamper or tamper the investigation or with the evidence. (iv) shall not misuse his liberty to commit any illegal acts or offences. 9.
Accordingly, this bail application stands disposed of. JUDGE
