The petitioner is apprehending his arrest in connection with Khelari PS Case No.42 of 2025, for offence registered under section 303(2), 317(2), 3(5) of BNS, 2023, 4/21 of Mines and Mineral (Development and Regulation) Act, 1957, section 54 of Jharkhand Minor Minerals Concessions Rules, 2004 and section 7/11 of Jharkhand Mineral Illegal Transportation and Storage Rules, pending in court of learned Judicial Magistrate First Class Ranchi.

Learned counsel for petitioner submits that petitioner is the owner cum driver of tractor and allegation is made that 100 cft sand was being carried on it and the petitioner has got no criminal antecedent as disclosed in para 9.
4. Learned State counsel opposes prayer and submits that 100 cft sand was being illegally carried.
5. Considering that petitioner is the owner cum driver of tractor and the petitioner has got no criminal antecedent as disclosed in para 9, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate First Class Ranchi, in connection with Khelari PS Case No.42 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
