JUSTICE SHAMIMA JAHAN ORDER Date : 31.10.2025 1. Heard Mr. A.V Singh, learned counsel for the appellant. Also heard Mr. K.K Parashar, learned Additional Public Prosecutor for the State of Assam. 2. This is an application for correction, rectification and modification of the order dated 27.10.2025 passed by this Court in Criminal Petition No. 1263/2025. Page No.# 2/2 3. By the said order dated 27.10.2025, this Court had allowed the petitioner to appear before the Ld. Trial Court within 7(seven) days from the date of the order. It be stated here that the said Criminal Petition was filed challenging the Non- Bailable Warrant of Arrest issued against the petitioner on 18.07.2019. The petitioner had also challenged the proclamation order issued against the petitioner along with fresh NBWAs. Mr. A.V Singh, learned counsel for the appellant states that although the petitioner was allowed to appear before the Ld. Trial Court, but the said order of NBWA as well as proclamation orders were not kept in abeyance till he appears. 4. As such, this Court modifies the order dated 27.10.2025 to the effect that the petitioner would go and appear before the Ld. Trial Court within 10(ten) days from the date of the present order without fail and if he does not appear, necessary actions would follow. Further, it is directed that the NBWA as well as the proclamation orders or any fresh NBWA, issued against the petitioners, be kept in abeyance till he appears and further, that on his appearance the Ld. Court will pass necessary orders as required under the law. 5. Petition is disposed of. JUDGE Comparing Assistant
