Rt. No.144, Dt.08.09.2020, issued by the Animal Husbandry, Dairy Development and Fisheries (Fish) Department, without there being any lease order in favour of the 6th respondent society to conduct Fishing operations for the Fasli 1431 (01.07.2022 to 60.06.2023), 1432 (01.07.2023 to 30.06.2024), un-authorizedly, in view of pendency of W.A.No.166 of 2021 and Batch (W.A. 326, 241 and 395 of 2021), in spite of giving Representation by the members of the Society, Dt.03.07.2023 and consequently direct the Respondents SRK, J WP No.17593 of 2023 3 2 to 5 not to allow the 6th respondent society to conduct any fishing operations un-authorizedly in the Somavarappadu Pedda Cheruvu, the only tank in the area of operation of the 6th Respondent Society pending disposal of W.A.No.166 of 2021 and Batch (W.A. 326, 241 and 395 of 2021) by considering the Representation given by the members of the Society, Dt.03.07.2023. KARIMULLA SHAIK SRK, J WP No.17593 of 2023 4 The Court made the following ORDER: This Writ Petition has been filed questioning the action of the Respondents 2 to 5 in allowing the President and Managing Committee members of the 6th respondent Society to conduct illegal fishing operations in “Somavarappadu Pedda Cheruvu”, contrary to G.O. Rt. No.144, dated 08.09.2020, issued by the Animal Husbandry, Dairy Development and Fisheries (Fish) Department, without there being any lease order in favour of the 6th respondent Society to conduct Fishing operations for the Fasli 1431 (01.07.2022 to 60.06.2023) and 1432 (01.07.2023 to 30.06.2024), un-authorizedly, in view of pendency of W.A.No.166 of 2021 and batch (W.A.Nos.326, 241 and 395 of 2021), in spite of giving representation by the members of the Society, dated 03.07.2023. 2. Today, when the matter came up for hearing, learned Counsel for the Writ Petitioners submitted that the cause in the Writ Petition does not survive for adjudication and the matter has become infructuous. 3. Recording the said submission, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
