This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“....
a WRIT OP MANDAMUS declaring the inaction on the part of respondents 2 to 8 particularly respondents 7 and 8 on petitioners representation dated 12.11.2020 submitted for initiating Proceedings under Chapter VIII and also Chapter X C and D of Criminal Procedure Code 1973 against the respondents 9 to 17 and their henchmen for their repeated illegal acts thereby causing breach of peace and disturbance to public tranquility at petitioners agricultural landed property of Ac 4 00 Cents covered by Survey No 1 2A5 situated to the North of Sy.No.188 of Komatikunta Revenue Village Gopalapuram Mandal of West Godavari District as illegal irregular irrational and amounts to non discharge of legal obligation conferred on respondents 2 to 8 under the provisions of the Code or Criminal Procedure 1973 and offends Articles 14 and 21 of Constitution of India and consequently direct the respondents 2 to 8 particularly respondents 7 and 8 to initiate proceedings under ChapterVIII and also Chapter X C and D Section 107 and 145 of Code of Criminal Procedure 1973 against respondents 9 to 17 and their henchmen.”

Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that the respondent-police called both parties and advised them to settle the matter before the Competent Court, as the dispute is civil in nature. However, without adhering to the said advice, they caused obstruction to public peace and tranquility. 3. For ready reference, the written instructions are extracted hereunder:
“It is further submitted that without following the advise they formed into two groups and frequently they may cause obstruction to the public peace and tranquility. For which destroying breach of peace and creating law and order problem due to the land dispute. Hence a case in Cr.No.186/2020 registered U/Sec 145, 107 Cr.PC on dt 03.12.2020 with the Gopalapuram Police Station, Charge sheet was

filed before the RDO Court Kovvuru vide MC No.6/2020 dated 04.12.2020.”

Recoding the said submissions and the contents of the written instructions, the Writ Petition is disposed of. There shall be no order as to costs.
