PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.’)/ Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the petitioner/Accused on bail in Cr.No.114 of 2025 of Malkapuram Police Station, Visakhapatnam District, registered against the petitioner / Accused herein for the offences punishable under Sections 20(b)(ii)(B) r/w 8(c), 25 of the of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. The case of the prosecution is that on 09.06.2025 at 11.15 hours, on receipt of credible information, Sub-Inspector of Police, Malkapuram Police Station, along with his staff and mediators, while conducting vehicle checking at IOCL lorry parking area, Malkapuram, Visakhapatnam City, found one scooty bearing No.AP 40 BJ 9391. On seeing the police party, the person tried to flee away, police caught the person. On verification of the vehicle, police found ganja in one brown colour tapped packet and seized the material along with vehicle under the cover of mediators report and registered a case. 3. Sri Ramineni Sudheer, the learned counsel for the petitioner, submits that the petitioner has not committed any offence; he was falsely implicated in 3 this case; he is sole breadwinner of his family; he is ready to abide any conditions to be imposed by this Court; and urged to enlarge the petitioner on bail. 4. Per contra, Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor, submits that there are no adverse antecedents against the petitioner with regard to the cases booked against him under the provisions of the NDPS Act. 5. Perused the record. 6. As seen from the record, the petitioner is allegedly found to be in possession of 2 kgs of ganja and he has been in judicial custody for the past 39 days. The petitioner is at an impressional age of 23 years. There are no adverse antecedents reported against the petitioner. 7. Considering the nature of the allegations levelled against the petitioner, the alleged role played in this case and the period of detention and the nature of quantity of the contraband, this Court deems it fit to enlarge the petitioner on bail. 8. In the result, the Criminal Petition is allowed with the following conditions: i. The petitioner/Accused shall be enlarged on bail subject to executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for a like sum each to 4 the satisfaction of the learned III Additional Chief Judicial Magistrate at Gajuwaka, Visakhapatnam. ii. On release, the petitioner / accused shall appear before the Station House Officer concerned, on every Sunday in between 10:00 am and 05:00 pm, for a period of three (03) months or till filing of the charge sheet. iii. The petitioner / accused shall not tamper or hamper the evidence and shall cooperate with the investigating officer in further investigation of the case and shall be available to the investigating officer as and when called by him. ________________________ DR.
