[2025:RJ-JP:35004] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 8911/2025 Bhura S/o Ramjilal, Aged About 29 Years, R/o Ond, Police Station Mandrayal, District Karauli (Raj.). (At Present Confined In District Jail Karauli). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Mukesh Pal Jadaun Mr. Anurag Chauhan Ms Indu Shekhawat For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 01/09/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 62/2025 registered at Police Station Mandrail, District Karauli for the offences under Sections 115(2), 126(2), 3(5) and 352 of BNS. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that the prima facie offence under Section 110 of BNS is not made out against the petitioner. The accused-petitioner is in custody since 28.06.2025 and the trial of the case may take considerable time, there are no criminal antecedents against the accused-petitioner. Concerned Doctor opined that injury sustained to injured at her head was simple blunt in nature, however the [2025:RJ-JP:35004] (2 of 3) [CRLMB-8911/2025] police submitted the charge-sheet against the petitioner for the offence under Section 110 of BNS, there are no material available on the record showing the fact that injured Rumali remained hospitalized in a private hospital. The prosecution has not submitted any document that injured Rumali was admitted in any hospital. In the CT scan report, fracture of right parietal region was present, however no x-ray report was submitted before concerned court, with the charge-sheet. The injuries sustained to injured Rumali were not opined to be dangerous to life, therefore considering the above facts, the bail application of the accused- petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that petitioner caused injury at the head of the injured Rumali, which was found to be grievous in nature, after conducting the CT scan of the injury. Injured also received other eight injuries, therefore considering the nature of injuries sustained to injured Rumali, the bail application of the accused-petitioner deserves to be dismissed. 4. Heard and perused the material available on record. 5. It is not desirable for the court to express anything on the merits of the case, considering the fact the accused-petitioner is in custody since long and the trial of the case may take considerable time, there are no criminal antecedents against the accused- petitioner, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Bhura S/o [2025:RJ-JP:35004] (3 of 3) [CRLMB-8911/2025] Ramjilal, in connection with FIR No. 62/2025 registered at Police Station Mandrail, District Karauli shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
