Heard Mr. K. Mohammed, the learned counsel for the petitioners and also heard Mr. K. K. Das, the learned Additional Public Prosecutor appearing on behalf of State respondent. 2. This petition under Section 482 BNSS is filed by the petitioners, namely, Billal Sk @ Billal Sheikh and Ashena Khatun, apprehending arrest in connection with Mankachar P.S. Case No. 87/2025 registered u/s 103/3(5) of BNS, 2023. 3. This is a subsequent bail petition, as an earlier bail petition was rejected by this Court on 25.09.2025 in AB 2279/2025. The earlier bail petition was filed by four petitioners including the present two petitioners and the said bail petition was partly allowed granting bail to one of the petitioner therein namely, Hashina Khatun for the reasons stated in that order. 3. The case diary has been received. The petitioners were granted interim bail vide order dated 25.11.2025. 4. The learned Addl. P.P. submits that as per note of the I/O, the petitioners have appeared but their statements have not been recorded, yet. On the earlier occasion, the prosecution had fairly submitted that, the investigation so far has not revealed any significant incriminating materials against the present petitioners. Page No.# 3/3
5. In view of the same, I do not deem it necessary to cancel the interim bail. Further, in view of the intervening the winter break, there is no much point in keeping the bail petition pending as well. 6. Accordingly, the interim bail granted to the aforesaid petitioners vide order dated 25.11.2025 is hereby made absolute, subject, of course, to the following conditions:- (i) he shall co-operate with the remaining investigation, (ii) he shall not hamper or tamper with the evidence.
(iii) he shall not commit any illegal activities. 7. Violation of any bail condition will entail cancellation of the bail. 8. Accordingly, this instant anticipatory bail application stands allowed and disposed of. 9. Send back the case diary. JUDGE
