1. This hearing has been done through hybrid mode.
2. The present petition has been filed by the Petitioner- Kapil Goyal under Articles 226 and 227 of the Constitution of India, inter alia, seeking release of the two gold chains of the Petitioner, weighing 177 grams, seized by the Customs Department videDetention Receipt No. 4089 dated 27th March,
2024. The petition also challenges Order-in-Original dated 25th July, 2024.
3. It is the case of the Petitioner that the detained goods were personal jewellery of the Petitioner. This was disputed by the ld. Sr. Standing Counsel. In view thereof, this Court on the last date of hearing i.e., 25th July, 2025 had
directed the detained goods to be produced on the next date of hearing.
4. Today, pursuant to the above directions, the detained gold items have been produced before the Court. The Seal has been opened in the Court itself. After perusing the same, it is clear that neither of them is an old or used gold chain. This is a digitally signed order. 5. In view thereof, the Order-in-Original dated 25th July, 2024 does not warrant interference in writ jurisdiction.
6. The Petitioner is, however, free to avail of his remedy in accordance with law. If the Petitioner wishes to file an appeal under Section 128 of the Customs Act, 1962 challenging the Order-in-Original, he may do so in accordance with law seeking condonation of delay, if permissible.
7. The gold chains have been returned to the officer concerned and have been resealed in the presence of the ld counsel for the Petitioner.
8. The petition is disposed of in the above terms. Pending applications, if any, are also disposed of.
