THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks the following reliefs: "a) To issue writ or order or direction in the nature of mandamus directing the Respondent University, to condone the attendance shortage on medical grounds considering medical reports request letter as an exceptional case, vide Annexures-E and G; b) To issue writ or order or direction in the nature of mandamus directing the Respondent University, to allow the petitioner to write On-Demand Examination or Re- Examination for III & IV Semester for the Course of Management of Business Administration (MBA) further by allowing petitioner to submit her assignments for IV Semester. c) To issue writ or order or directions in the nature of mandamus directing the Respondent University to declare - 3 - NC: 2025:KHC:17575 WP No. 12125 of 2025 results of the said III & IV Semester of the petitioner’s MBA Course; d) To issue writ or order or directions deemed fit to this Hon’ble Court, in the circumstances of the case, in the interest of justice with cost.” 2. Heard learned counsel for the petitioner and learned counsel for the respondents and perused the material on record. 3. In addition to reiterating the various contentions urged in the petition and referring to the material on record, learned counsel for the petitioner submits that on account of recurring health reasons and ailments of the petitioner, petitioner would be entitled to appear in the III Semester examination vide notification dated 02.12.2024 under On Demand Examination (ODE) as well as appear in the regular examination scheduled to commence from 09.05.2025 for IV Semester and necessary directions may be issued to the respondents in this regard. 4. Per contra, learned counsel for the respondents – University submits that if reasonable time is granted, respondent – University would consider the request of the petitioner and take appropriate decision / pass appropriate orders, in accordance with law. - 4 - NC: 2025:KHC:17575 WP No. 12125 of 2025 5. In view of the aforesaid facts and circumstances, I deem it just and appropriate to dispose of this petition directing the respondents to consider the request of the petitioner to appear in On Demand Examination (ODE) for III Semester and regular examination scheduled to commence from 09.05.2025 and take appropriate decision / pass appropriate orders, in accordance with law, on or before 05.05.2025. 6.
