By this petition filed under Section 482 of the Bharatiya Nagarik Suraksha Page No.# 2/3 Sanhita, 2023, the petitioners, namely, Jairul Islam Talukdar, has prayed for granting pre-arrest bail, apprehending arrest in connection with Doboka P.S. Case No. 109/2025 under Section 318(4)/336(3)/338 of BNS, 2023. 3. The case arose out of an Ejahar dated 18.06.2025 alleged by the Circle Officer, Doboka Revenue Circle in the district of Hojai. The allegation is that the petitioner who serving as Aadhar operator centre was involved in manipulation of Aadhaar process, incorporating fictitious persons also in the Aadhaar system, by such manipulation. 4. This is the subsequent bail application as the earlier bail petition was rejected by this Court on 04.08.2025 in AB/1523/2025. The learned counsel for the petitioner has drawn my attention to relevant documents annexed with the bail petition and the reply of show cause notice which was given to him from the office of Deputy Commissioner, Hojai. It is also submitted that the petitioner is ready to co-operate with the investigation and record his statement and that his custodial detention may not be necessary. Drawing attention to annexure - 4, it is also contended that he has been subjected to black mail and malicious allegations vis-à-vis the present police case registered against him. 5. Case diary has been received along with bail objection. 6. The learned Additional Public Prosecutor submits that the investigation is still in progress and case diary has been placed before this Court with the relevant portions flagged. The learned prosecution has drawn my attention to the statement of one civil servant stated to be the Nodal Officer, Aadhaar in the office of Deputy Commissioner, Hojai. His statement lends support to the allegation about tampering of the Aadhaar system on the part of the petitioner Page No.# 3/3 and his brother. 7. I have also perused the statement of the complainant as well as other materials and the witnesses. 8. The I/O has contended in the bail objection that the investigation is at the crucial stage and investigation has found materials regarding the present accused/petitioner and his brother of tampering with Aadhaar biometric data. It is also contended that materials have been found about the offences being of an organized manner and investigation is on to ascertain the involvement of other persons. The learned prosecution supports the bail objection and opposes the grant of bail. 9. Upon giving due consideration to the matter, I am unable to find sufficient new grounds to allow this subsequent bail petition which accordingly, stands rejected at this stage. 10.
