This is the First bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023, for grant of regular bail to the applicant who has been arrested in connection with Crime No. 33/2025 registered at Police Station Bhanpuri, District– Bastar (C.G.), for the offence punishable under Section 34(2), 43 of the Digitally signed by NADIM MOHLE 2 / 3 Chhattisgarh Excise Act. 2. Case of the prosecution, in brief, is that on the basis of secret information received, Assistant Sub-Inspector Suryaprakash Sahu conducted a raid at a roadside dhaba. During the search operation, a significant quantity of 528.500 liters of liquor, amounting to Rs. 2,70,790, was recovered from the possession of the accused. The entire operation was conducted in the presence of independent witnesses. Consequently, a case was registered under Section 34(2) of the Chhattisgarh Excise Act, and Crime No. 33/2025 was lodged against the accused. 3. Learned counsel for the applicant submits that the present applicant has been falsely implicated in this case. He further submits that the present applicant has been in jail since 13.03.2025 and conclusion of the trial may take some time, therefore, he prays for grant of regular bail to the present applicant. 4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the quantity of illicit liquor is 528.500 liters, thus, the applicant is not entitled to be released on bail. 3 / 3 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case and further the fact that the illicit liquor which has been seized from the possession of the present applicant is huge quantity i.e. 528.500 liter amounting to Rs.2,70,790/-. 7. Accordingly, the bail application of the applicant – Ranjeet Kumar Gupta involved in Crime No. 33/2025 registered at Police Station Bhanpuri, District– Bastar (C.G.), for the offence punishable under Section 34(2), 43 of the Chhattisgarh Excise Act, is hereby rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
