Neutral Citation No. - 2025:AHC:34684-DB Court No. - 29 Case :- WRIT - C No. - 7087 of 2025 Petitioner :- Brajesh Kumar Gautam Respondent :- The State Of U.P. And 4 Others Counsel for Petitioner :- Ram Lal Mishra,Sr. Advocate Counsel for Respondent :- Ashok Kumar Tiwari,C.S.C.,Sr. Advocate,Vishakha Pande Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. This petition has been filed by the petitioner claiming himself to be Ex-Treasurer of District Bar Association Mathura challenging the decision taken by the Bar Council of Uttar Pradesh whereby the decision taken by the Bar Association Mathura against two of its members has been interfered with. Various arguments are raised to challenged the order. Sri Ashok Kumar Tiwari, learned counsel for the respondent no.2, however, raises an objection to the maintainability of the writ petition on the ground that neither petitioner is the person aggrieved nor the petition has been filed on behalf of Bar Association and, therefore, he has no locus to intervene. Sri Rakesh Pandey, learned counsel for respondent nos.4 and 5 also supports the objection taken by learned counsel for the Bar Council of Uttar Pradesh. Various legal issues raised by the petitioner can be examined only in a petition filed by the person, who has locus to raise such grievance. The person who have ousted and in respect of which protection has been granted are respondent nos.4 and 5. The person aggrieved would be the Bar Association, Mathura which has not filed the writ petition. At the instance of an individual member we are thus not inclined to entertain the present writ petition even if the petitioner had previously held the elected office. On account of lack of locus in the petition to intervene, we dismiss the writ petition. Order Date :- 10.3.2025 RA Digitally signed by :- RAZIQ ALI High Court of Judicature at Allahabad
