Heard learned counsel Mr. W. R. Medhi, for the petitioner, Songbijit Ingti Kathar @ IK Songbiit @ Sarsing Engti @ Sarsing Ingti Kathar @ Sangbijoy, who has filed this application under Section 528 of the BNSS read with Article 227 of the Constitution of India with prayer to recall the Non-Bailable Warrant of Arrest (NBWA) along with the P&A and also with a prayer by the petitioner to prefer a bail application before the Trial Court 2023 in connection with Special U.A.(P) Case No. 01/2025 registered under Sections 16/18/20 of UA (P) Act being transferred vide Special NIA Case No. 05/2015 arising out of RC-03/2014/NIA- GUW dated 22.07.2014 and further arising out of Gossaigaon PS Case No. 155/2014 dated 03.05.2014 underSection448/457/302/307/326/324/427/34 IPC read with Section 27 of the Arms Act added Section 16/18/20 of the UA(P) Act currently pending before the Court of the learned Special Judge, Kokrajhar. Heard Mr. B. Sarma, learned Additional Public Prosecutor for the respondent State. It is submitted that the petitioner is booked under several cases, and in similar cases, orders have been passed by a coordinate Bench of this Court in I.A. (Crl.) No. 1174/2025 and Crl.Pet.No. 1271/2025, directing the petitioner to appear before the Trial Court and prefer a bail application. I have considered the submissions at the Bar. The petitioner is willing to cooperate with the trial. It is further submitted that the petitioner is a surrendered NDFB cadre and he is trying to participate in the ongoing peace
Page No.# 3/3 process and become a part of the mainstream. As the petitioner is willing to cooperate with the trial, it appears that the petitioner may be directed to approach the learned Trial Court.
Thereby, the petitioner is directed to appear before the learned Trial Court and apply for Bail and to also pray for any other relief which may be considered by the learned Trial Court in accordance with law. The NBWA and P&A issued against the petitioner including any subsequent NBWA, is kept in abeyance for a period of 15 (fifteen) days, and within 15 (fifteen) days the petitioner is directed to appear before the learned Trial Court.
