Judgment / Order 12/05/2025 Since, both these writ petitions share similar facts and com- mon question(s) of law, they have been heard together and are being disposed of vide this common order.
Learned counsel for the respective parties agreed that the is- sue involved herein is no more res integra and stands resolved by a coordinate Bench order of this Court dated 03.01.2025 passed in the case of Nathu Lal Jaroli versus State of Rajasthan & Ors.: S.B. Civil Writ Petition No.10394/2011 and pray for disposal of the writ petitions in terms thereof. In the case of Nathu Lal Jaroli (supra), this Court held that
order passed under Rule 54 of the Rajasthan Service Rules, 1951 forfeiting the monetary benefits except the subsistence allowances for the suspension period on account that acquittal of the em- ployee was not honorable but, extending the benefit of doubt, is not tenable and is bad in law. In view thereof, the orders impugned in the writ petitions dated 22.07.2024 and dated 19.03.2024 are quashed and set aside and the respondents are directed to pay salary and other al-
[2025:RJ-JP:19897] (3 of 3) [CW-6476/2025] lowances for the petitioners for the suspension period within a pe- riod of twelve weeks from today. If the payment is not made within the stipulated period, the arrears shall carry interest @ 6% per annum and the Officer(s) re- sponsible for the delay would bear the interest. In view thereof, the writ petition is disposed of. Pending ap- plication(s), if any, also stands disposed of.
