“10.1 That, this Hon'ble Court may kindly be pleased to quash impugned order dated 05.05.2025 passed by the respondent No.-2. 10.2 That, this Hon'ble Court may kindly be pleased to issue any other writ /order/ direction as deem fit in the facts and circumstances of the case.”
2. Learned counsel for the petitioner submits that the petitioner is holding the post of Veterinary Assistant and posted at Veterinary Hospital Nangur, Block- Jagdalpur, District- Bastar. Pursuant to
order Annexure P-1, his service has been attached to the Veterinary Hospital Mutampal, Block – Kilepal. His contention is that service of petitioner cannot be attached to any other office as held by Division Bench of this Court in Writ Appeal No.413 of 2024 and other connected appeals. He also submit that though there is no specific mention in the order that service of the petitioner has been attached to Veterinary Hospital Mutanpal, however, effect of posting of petitioner in the said hospital is to be of attachment and not the order of transfer. Petitioner has also submitted representation before respondent No.2/Collector on 07.05.2025 which is still pending consideration. Petitioner, till date, has not been relieved from present place of posting and is still performing his duty at Veterinary Hospital, Nangur.
3. On the other hand, learned counsel for the State opposes the submission of learned counsel for the petitioner and would submit that from contents of order Annexure P-1 it is clear that it is not an
order of attachment but it is only an order of posting.

4. I have heard learned counsel for the parties.
5. Considering the submission of learned for the petitioner and also considering the contents of order which only mentions that petitioner has been posted from one place to another and as submitted by learned counsel for the petitioner that now the petitioner has been posted about 100 km away from present place of posting, order does not mention that petitioner has been transferred from Veterinary Hospital Nangur to Veterinary Hospital Mutanpal, petitioner has also raised grievance before respondent No.2 who had issued the order Annexure P-1 which is still pending
consideration, instead of seeking reply from respondents, purpose of filing of writ petition would be served if respondent No.2 is
directed to consider and decide representation of the petitioner Annexure P-6 dated 07.05.2025 expeditiously, preferably within a period of two weeks from the date of receipt of order passed by this Court .
6. Petitioner will also be at liberty to submit fresh detailed representation before respondent No.2 and if such representation is submitted, respondent No.2 shall also consider and decide the same along with representation dated 07.05.2025 (Annexure P-6) in accordance with law, as directed above.
