Order: Heard the learned counsel appearing for the petitioners and the learned Assistant Public Prosecutor appearing for the State.
2. The learned counsel for the petitioners submits that the petitioners have purchased land admeasuring Ac.0.03 cents, and a certificate to that effect issued by the Village Revenue Officer, which Tahsildar, Bommanahal. It is submitted that a resolution was was duly attested by the was also passed by the Grama Panchayat on 03.07.2023 permitting the shifting of the old shed. which was earlier used for rural livestock. After purchasing the land, the petitioners cleared the site. However, a complaint was filed by the 2 respondent alleging that the petitioners had illegally demolished a structure belonging to the veterinary department. nd
3. Considering the submissions of the learned counsel for the that the property was purchased by the petitioners, and that petitioners a certificate of ownership was issued by the Village Revenue Officer, duly attested by the Tahsildar, and that a registered sale deed was also executed on 12.02.2024 this Court is inclined to direct the Investigating Officer to complete the investigation without taking any coercive steps against the petitioners and by strictly complying with the provisions of Section 35(3) of the BNSS.
4. Accordingly, this Criminal Petition is disposed off.
4 As a sequel, miscellaneous petitions pending, if any, shall stand closed.
