Saraf,J. Hon'ble Vipin Chandra Dixit,J. 1. Heard learned counsel appearing on behalf of the parties. 2. This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner has made the following prayers:- (i) Issue a Writ, order or direction in the nature of Certiorari quashing the letter impugned order dated 09.01.2025 therein, the candidature of the petitioner has been declared ineligible for award of Retail Outlet dealership at between Etawah-Auraiya border and Km stone No96 on NH-34 Bharthana-Kannauj Road, District Auriya. (ii) Issue a writ, order or direction in the nature of Mandamus directing the respondents to decide the representation of the petitioner moved before the authority concern on 17.01.2025. (iii) Issue any other order or direction as this Hon'ble court may deem fit and proper under the circumstances of the case. (iv) Award cost of the Writ petition to the petitioner." 3. The reasons for rejection of the candidature of the petitioner for grant of retail outlet dealership is that the lease deed submitted by the petitioner has not been executed by all the co-owners. The khatauni papers produced by learned counsel appearing on behalf of the respondents indicates that there are several co-owners of the property while the lease deed has only been executed by one co- owner. 4. In light of the same, we do not see any reason to interfere with the impugned order. 5. Learned counsel appearing on behalf of the petitioner submits that a representation has been filed by the petitioner on January 17, 2025 after receipt of the order of rejection. The said representation is still pending with the authorities. 6. Accordingly, authority concerned is directed to grant an opportunity of hearing to the petitioner, and thereafter, pass a reasoned order on said representation within a period of four weeks from date. 7. With the above direction, the writ petition is disposed of. Order Date :- 5.3.2025 Dev (Vipin Chandra Dixit,J.) (Shekhar B. Saraf,J.)
