Respondent(s) (Cause Title is taken from Case Information System) Digitally signed by NADIM MOHLE -2- For Petitioner : Ms. Anushka Sharma, Advocate, holding the brief of Mr. Manoj Paranjpe, Advocate For State : Mr. Shubham Bajpai, Panel Lawyer Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 07.07.2025 1) The petitioner has filed this petition seeking the following relief(s):- “10.1] That, this Hon'ble Court may kindly be pleased to issue a writ/writs, direction/directions, order/orders quashing the impugned order dated 21.07.2017 so far as it relates to grant of senior selection grade to the private respondents is concerned is concerned and the petitioner may kindly be granted senior selection grade with effect from the same date i.e. 21.07.2017 along with all consequential benefits. 10.2] That, this Hon'ble Court may kindly be pleased to grant any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstances of the case.” 2) Learned counsel for the petitioner would submit that the benefit of Senior Selection Grade was extended to the juniors to the petitioner, but the petitioner's name was not considered when he was posted as Joint Director. It is further submitted that the benefit of Senior Selection Grade was granted to the juniors of the petitioner on 21.07.2017. It is also submitted that the petitioner made representations before the respondent authorities on 25.07.2017 & 17.10.2017, but till date same are not decided by the respondent authorities; thus, she would pray that appropriate direction may be issued to the respondent authorities to consider and decide the pending representations. 3) On the other hand, learned counsel appearing for the State would oppose the submission made by counsel for the petitioner and submit that the petitioner -3- was not found eligible for the grant of Senior Selection Grade pay; hence, he was not extended that benefit. He would further submit that the Departmental Promotion Committee (for short, DPC), after considering five years’ Annual Confidential Reports (for short, ACRs) of all eligible candidates, recommended the names of certain government servants for grant of Senior Selection Grade. It is, therefore, contended that the present writ petition may be dismissed. 4) Heard. 5) Taking into consideration the fact that the petitioner has already made representations on 25.07.2017 & 17.10.2017, which have not been decided till date, at this juncture, this petition is disposed of with a direction to respondent No.1 to consider the representations made by the petitioner in an objective manner and pass appropriate order(s) preferably within a period of 120 days from the date of receipt of a copy of this order. 6) With the aforesaid observation(s) and direction(s), the writ petition stands disposed of at the admission stage itself. 7) It is made clear that this Court has not expressed any opinion on the merits of the case.
