Ahmed, the learned counsel for the petitioner and also heard Page No.# 2/3 Mr. R.J. Baruah, the learned Additional Public Prosecutor appearing on behalf of State respondent. 2. This is an application u/s 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 for granting pre-arrest bail to the accused/petitioner in connection with Sapatgram P.S. Case No. 36/2025 u/s 303(2)/318(4)/317(2)/3(5) of Bharatiya Nyaya Sanhita (BNS), 2023. 3. It is submitted by Mr. Ahmed that the present accused/petitioner is no way connected with the alleged offence nor he is dealing with any business of areca nuts. However, he is working as a Courier Agent in a transport company wherefrom he has given the truck for the said consignment. He further submitted that while delivering the truck to transport the areca nuts, he verified all the Tax Invoices, Challans etc. and after finding those genuine, he delivered the truck for transporting of the areca nuts. Further, he submitted that the owner of the truck also prayed for zimma of the vehicle, which has already been given in favour of the truck owner. However, the petitioner is ready and willing to cooperate with the I/O in further investigation of this case, if he is granted with the privilege of interim pre-arrest bail. 4. Mr. A. Ahmed, learned counsel for the petitioner submits that one co- accused Munna Ajij has already been granted anticipatory bail by this Court vide order dated 17.09.2025 in AB No. 1924/2025. 5. It is also submitted that in the meantime, the case has been charge- sheeted upon completion of investigation. 6. In view of the completion of investigation and also bail to co-accused, the interim bail granted to the aforesaid petitioner vide order dated 12.08.2025 is hereby made absolute, subject, of course, to the following conditions:- Page No.# 3/3 (i) he shall render co-operation in the trial and also co-operate with the process of law. (ii) he shall not hamper or tamper with the evidence. (iii) That the accused person shall not misuse his liberty to commit any offences or any illegal activities, 7. Violation of any bail condition will entail cancellation of the bail. 8. Accordingly, this instant bail application stands allowed and disposed of. 9. Send back the case diary.
