By way of present application, indulgence of this Court has been sought to restore Civil Revision No. 89 of 2025, which was dismissed for non- prosecution, on 6.10.2025. Although, in the application, it has been mentioned that order dated 6.10.2025 was passed on account of the fact that no one has put appearance on behalf of petitioner, however, as per the aforesaid order, the same was dismissed for non-prosecution, as steps had not been taken for the service of respondents No. 12 to 14. It has been submitted by learned Senior Advocate, appearing for the petitioner, at the Bar, that steps have already been taken for the service of respondents No. 13 and 14. Considering the true import of the procedural law, according to which, the matter should be decided on merits, and not on the basis of technicalities, the order dated 6.10.2025 is ordered to be recalled and the present petition is ordered to be restored to its original number.
The application stands disposed of. C.R. No. 89 of 2025 Vide order of even date, passed in CMP No. 26691 of 2025, the present petition has been restored to its original number. Steps for the service of respondents No. 13 and 14 be taken during the course of the day, if not already taken.
