JUSTICE AMIT BANSAL O R D E R % 07.01.2026 1. The petitioner in the present petition is in the process of setting up a 300 MW wind power project in Ujjain, Madhya Pradesh. 2. The present petition has been filed seeking stay of the Notice dated 18th December, 2025 issued by the respondent no.1/ Central Transmission Utility of India Limited (CTUIL) intimating the petitioner that 300 MW connectivity granted to the petitioner for its wind power project is liable to be revoked by 30th December, 2025. Notice in the present petition was issued on 24th December, 2025 and the predecessor bench, taking note of the submissions of the petitioner, restrained the respondent no.1 from taking any coercive action including revocation of the petitioner’s connectivity as well as encashment of any bank guarantee furnished by the petitioner till the next date of hearing. 4. Counsel appears on behalf of the respondent no.1 and submits that the sitting of Central Electricity Regulatory Commission (CERC), the respondent no.2, is scheduled on 13th January, 2026 on which date both the parties shall make a request to CERC to take up the petition filed by the petitioner herein including the application for interim stay for hearing on 13th January, 2026. 5. In view thereof, CERC is requested to take up the petitioner’s application for interim stay on 13th January, 2026 or any other day shortly thereafter. 6. Accordingly, it is directed that status quo shall be maintained and no precipitative steps or action shall be taken by the respondent no.1 qua the bank guarantees furnished by the petitioner or the connectivity granted to the petitioner as per the Connectivity Agreement dated 22nd March, 2024. 7. It is clarified that the present status quo order is being passed for a limited period till the matter is taken up for hearing and considered by CERC. 8. It shall be open for CERC to consider whether or not continuation of the aforesaid interim direction is warranted or not, considering the facts and circumstances of the case. 9. It is made clear that this Court has not expressed any opinion with regard to the merits of the case. This is a digitally signed order.
