THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 17108 OF 2025 ORDER: The present Writ Petition is filed questioning the action of the Respondents 3 and 4, in threatening to demolish the Petitioner’s shop bearing D.No. 28-43, 44, (Assessment No.1131011333), Lawyerspet, situated on the northern side of Narasaraopet - Kurnool Road, Vinukonda Town, Palnadu District, without following due process of law as illegal and arbitrary.
2. The Petitioner claims to be the owner of the madras tiled shed of an extent of 9.72 sq.yds bearing D.No. 38, Block No.28 situated in Vinukonda, through a Registered Sale Deed No. 3239/1995, dated 04.09.1995. As there was a threat of dispossession, the present Writ Petition came to be filed.
3. Ms. V. Sireesha Rani, learned Standing Counsel for the Respondent No.4/ Municipality, on instructions, would submit that the Respondent No.4 will follow the procedure as contemplated under law, in case, any action is to be initiated against the Petitioner in respect of subject property.
4. Taking note of the submissions made by learned Standing Counsel for the Respondent No.4, the Writ Petition is disposed of, directing the Respondents to examine the title deeds of the Petitioner, in respect of subject property, before initiating any action against the Petitioner, if necessary, and follow the procedure as recognized under law. No order as to costs.
