Heard Sri V.R. Reddy Kovvuri, learned counsel for the petitioner and learned Assistant Government Pleader for Registration and Stamps, for respondents 1 to 3. 2. The above writ petition is filed to declare the inaction of respondent No.2 in taking action against respondents 4 and 5, who failed to conduct general body meetings as per the bye-laws of the Taylor High Schools Old Students and Welfare Association, Santipuram, Kuppam and Yalagiri, Chittoor District, as illegal and arbitrary. 3.
Learned counsel for the petitioner would submit that petitioners 1 and 2 are the Coordinator and Executive Member, respectively, of Taylor High School's Old Students and Welfare Association. The said association was registered under the provisions of the Andhra Pradesh Societies Act, 2001 (hereinafter referred to as ‘the Societies Act’). Learned counsel would submit that as per Bye-law 4 of the bye-laws of the association, a meeting has to be designated by the board of the association and as per Bye-law No.5, the Secretary of the association is bound to issue notices to members. As per Bye-law 7, the management of the association shall vest with the executive committee elected by the general body, which will act subject to the rules and regulations. Learned counsel would submit that respondents 4 and 5, being President and Secretary of the Association, are acting contrary to the interest of the association. Petitioners made a representation, dated 02.01.2025, to respondent No.3. However, respondent No.3 failed to take any action. Hence, the writ petition. 4. Learned Assistant Government Pleader would submit that respondent No.3 has no role to play in the affairs of society. He would submit that if there is any dispute among the members of the society, the petitioners have to invoke the jurisdiction of the competent Court under Section 23 of the Societies Act. As seen from the pleadings, the grievance of the petitioners is that the District Registrar, respondent No.3 has not considered the representation, dated 02.01.2025 (Ex.P3), made by the petitioners and others, requesting the District Registrar, Chittoor District, to provide information regarding board meetings and furnish financial accounts concerning the Association with Reg. No.145/2012, in the opinion of this Court, is beyond the jurisdiction of respondent No.3. 6. As rightly contended by the learned Assistant Government Pleader, if there is a dispute among the members of the society, the petitioners have to invoke Section 23 of the Societies Act. 7. Thus, the grievance of the petitioners that respondent No.3 failed to consider their representation is misconceived.
