Essentially, the petitioner has filed this writ petition seeking a direction to the respondent authorities to complete the Departmental Proceedings (DP) initiated against him, in respect of which the representations dated 25.09.2025 and 29.10.2025, submitted by him for the early completion of the DP, are pending consideration. 3. Pursuant to the order of this Court dated 10.01.2024, passed in WP(C) No. 4334/2019, the respondent authorities has initiated the DP against the petitioner, the order, which is extracted hereinbelow:
“…After careful consideration of the above stated facts, materials on record and findings on the enquiry regarding several allegations of misbehaviour and mental harassment to lady teachers of the school submitted by Director of Secondary : Education, Assam the Director of Secondary Education is hereby directed to immediately suspend Shri Mridul Kumar Laskar, Headmaster of Dakhin Kampur High School, Nagaon District under Rule 6(1) of the Assam Services(Discipline and Appeal) Rules, 1964, and take necessary action to draw Disciplinary Proceeding against him by appointing an Inquiry Officer with the direction to conclude the inquiry within a month and furnish a detailed action taken report on the matter after conclusion of the D.P. to the Department of School Education.”
4. It is the limited submission of Mr. D. Mahanta, learned counsel, that the petitioner has filed representations on 25.09.2025 and 29.10.2025 for completion of the DP, which are yet to be considered by the respondent authorities. Therefore, he submits that the writ petition may be disposed of with a direction to the respondent authorities to consider and dispose of the representations dated 25.09.2025 and 29.10.2025 within a specified time frame. 5. Mr.
P. P. Dutta, learned Standing Counsel, Secondary Education Department, fairly submits that he would not have objection if the respondent authorities are directed to dispose of the representations of the petitioner. 6. Having considered the submissions of the learned counsel for the
Page No.# 3/3 parties and considering the limited prayer for disposal of the representations filed by the petitioner for early completion of the DP initiated against him, I deem it appropriate to dispose of this writ petition with a direction to the respondent authorities to consider and dispose of the representations of the petitioner dated 25.09.2025 and 29.10.2025 within a period of 2 (two) months from today. It is directed, accordingly. 7. It is observed that, since Mr. P. P. Dutta, learned Standing Counsel, Secondary Education Department, has fairly submitted that the DP against the petitioner is on the verge of completion, the respondent authorities shall bring the DP to its logical conclusion as expeditiously as possible. 8.
