THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.17385 of 2024 ORDER:
1. The present Writ Petition is filed questioning the action of the Respondents in withholding the undisputed bill amounts of Rs.15,01,103/- and Rs.18,05,066/- payable to the Petitioner in respect of the works i.e. (i) Providing fencing to the open spaces at RGK Marikavalasa identified during GGMP Programme under RGK Marikavalasa Secretariat jurisdiction in Ward No.05 of Zone-II in Bheemili Constituency of GVMC vide Agreement No.151/2022- 23/EE-II/DB, dated 14.10.2022 and (ii) Providing Community Shelter building at YSR Colony under Sachivalayam in Ward No.05 of Zone-II vide Agreement No.140/2023-24/EE-II/DB, dated 28.09.2023 even after finalizing the bills, as illegal and arbitrary. 2. Heard Sri C. Subodh, learned counsel for the Petitioner and Sri A.S.C. Bose, learned Standing Counsel for the Respondent- Corporation. 3. The learned counsel for the Petitioner submits that though the Petitioner had completed the works as per the Agreements mentioned above and the bills were prepared in November, 2023, no amounts were being paid. Hence, the present Writ Petition is filed. 4. The learned Standing Counsel for the Respondent-Corporation passed on the written instructions signed by the Executive Engineer, Greater Visakhapatnam Municipal Corporation, Visakhapatnam, wherein it is stated that the Petitioner had executed the works as specified in the Agreements and final bill was recorded vide M. Book No.174/2022-23 from Page Nos.1 to 34 and the bill was recommended

for payment of Gross amount of Rs.16,42,611/- and Net amount of Rs.15,01,103/- and also passed the bill vide EA No-GGMP-191 regarding the first Agreement.
It was mentioned that the Petitioner executed the works as per the Agreement and final bill was recorded vide MB No.1061/2018-19 from Page Nos.52 to 72 and the bill is recommended for payment of Gross amount of Rs.19,91,064/- and Net amount of Rs.18,05,662/- and also passed the bill vide EA No-GGMP-192 regarding the second Agreement. 5. As there is no dispute with regard to the execution of works and the amounts due to the Petitioner, the Writ Petition is disposed of, at the stage of admission, with the consent of both sides counsel by placing the written instructions on record, with the following direction:
(i) The Respondent authorities are directed to pay the
amounts due to the Petitioner within a period of four (4)
