3. Petitioner’s husband Late Moti Lal Kapoor was serving as Private Secretary Grade IV, who died while in service on 10.05.2013. His widow filed this writ petition in 2015 claiming the benefits, which allegedly was denied to her husband.
4. Learned State Counsel refers to Annexure 1 to the counter affidavit filed by Mr. N.S. Dungariyal, Deputy Secretary, Secretariat Administration Department, Government of Uttarakhand, which is a Government
Order dated 07.12.2015. Learned State Counsel submits that whatever was due to petitioner’s husband has now been sanctioned and all benefits were paid.
5. Perusal of the said Government
Order reveals that petitioner’s husband was promoted to the next higher posts on 16.01.2003, 07.11.2005 &
13.07.2009.

Learned counsel for the petitioner concedes that after passing of the said
order, the relief, as claimed by the petitioner, does not survive.

7. In view of the Statement made by
learned counsel for the parties, the writ petition is dismissed as infructuous.
