The petitioner has alleged non-compliance of the order passed by this Court dated 20.12.2019 , the operative portion of which is as under:- “Writ petition is, accordingly, disposed of with a direction to the respondents to consider the claim of the petitioners on the basis of averments made in the writ petition, annexures attached thereto and in light of above referred judgment (supra) provide d the same is applicable to the case of the petitioners. Let a decision be taken in the matter within a period of eight weeks from the date a certified copy of this order, copy of judgment referred to herein above along with complete set of writ petition is made available to them” 2. Compliance report stands filed by the respondents, wherein, it is stated that in compliance to the directions of this Court, the respondent No. 3 (Executive Engineer, Jal Shakti (PHE) Division Nowshera) scrutinized the office record, the case of the petitioners was examined meticulously under rules and found that the petitioners are not eligible for the grant of benefit of the higher grade under SRO-59 of 1990, as the provisions of career 2 CCP(S) No. 83/2022 progression to all the categories of employees are available under SRO 14 of 1996, which were already availed by the petitioners during their service period from time to time, as such, in light of the above, the case of the petitioners was rejected for extension of higher grade vide order No. 6391 dated 20.12.2022. 3. Learned counsel for the respondents states that the order/judgment passed by this Court has been complied with in its letter & spirit. 4. The contempt proceedings are, accordingly, closed.
