3. ELEVATED AS JUDGE The Court made the following: ORDER: The Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“…..declaring the inaction of the respondents in evicting the encroachers from the land admeasuring Ac.0.50 cts in Sy.No.448 and 449 situated at Pedakakani Village and Mandal, Guntur District even after obtaining the eviction orders U/Sec.83 of Act 30/87 and having knowledge

about the propagation of other than Hindu religion i.e., Christianity in the temple property as illegal, arbitrary, void, against the principles of natural justice and consequently direct the respondents to forthwith take appropriate action for eviction of encroachers and pass such other order or orders…..”
2. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Endowments, appearing for the respondents 1 to 3. 3. This Court vide order dated 02.12.2015 has granted interim order, which reads as under:
“….respondent No.5 is directed to extend protection to the officials of respondent No.4 as and when they approach him to ensure that the encroachers are evicted without creating law and order problem.”
4. The 4th respondent filed counter. While denying the contents of the writ petition, he stated that, in compliance of the interim order passed by this Court, the Executive Officer of the 4th respondent temple has made a representation to the Superintendent of Police, Guntur Urban on 10.12.2015 to provide police protection to evict the encroacher.
Thereafter, the Assistant Commissioner of Endowments Department along with other police personnel, were present on 15.12.2015 at the scheduled premises and despite the protest of the encroacher, the possession of the property measuring one room in front of the tin shed in an extent of Ac.0-50 cents in Sy.Nos.488 and 499 of Pedakakani Village and Mandal, was taken over by the Executive Officer of the 4th respondent from the Assistant Commissioner of Endowments Department in the presence of police and revenue officials under possession

certificate dated 15.12.2015 duly executing the orders of the Deputy Commissioner passed in O.A.No.145 of 2004, dated 06.01.2007. As such, the orders of this Court have been complied with, hence, the writ petition may be closed. 5. Recording the above submission, the Writ Petition is closed. No order as to costs. 6.
