IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 6129 of 2024 ---- Abdul Jamal Gaddi @ Abul Jamal, S/o late Abdul Qadir Gaddi, R/o 28, Gwala Toli, PO: GPO, PS: Hindpiri, District Ranchi. ….. Petitioner
Versus The State of Jharkhand …. Opposite Party
CORAM :
SRI ANANDA SEN, J.
------
For the petitioner(s) : Mr. Niranjan Kumar, Advocate
For the State : Mr. Jitendra Pandey, APP
-----
07/07.05.2025: Heard the learned counsel for the petitioner and the learned counsel for the State.
2.
This is an application filed by the petitioner praying for grant of anticipatory bail in terms of sections 482 and 484 of Bharatiya Nagrik Suraksha Sanhita, 2023, as the petitioner has been allegedly implicated in connection with Hindpiri PS Case No. 79 of 2022 for the offences punishable under sections 147,148,149, 353 120B/295A of the Indian Penal Code, pending in the court of learned CJM, Ranchi.
3.
The allegation against the petitioner is that on 10.06.2022 he along with others gathered near a mosque and by forming an unlawful assembly tried to outrage religious feeling of one class and when the police force tried to stop them they became violent and started pelting stones upon the police force.
4.
The learned counsel for the petitioner submits that in a similar case one of the co-accused, namely, Majid Alam has been released on anticipatory bail vide order dated 02.9.2024 passed in ABA No. 3764 of 2024 by a coordinate Bench of this Court. Hence, the petitioner seeks parity.
5.
Learned counsel for the State opposes the prayer of anticipatory bail.
6.
After going through the order passed in ABA No.3764 of 2024, I find that there is no reason for grant of anticipatory bail. Only the submissions of the petitioner and APP have been noted and, thereafter, bail was granted. Thus, this order will not have any binding effect upon this Court.
7.
So far as the present petitioner is concerned, he led a mob and was fully involved in the alleged offence and also obstructed the police personnel when they were performing their duties.
8.
I do not find this case fit for grant of anticipatory bail. The petitioner should surrender in the learned court below and take all the points before the court concerned which will be considered without being prejudiced by the order of this Court.
9.
This application is thus dismissed.
