This application has been filed under section 483 of the Bharatiya Nagarik Suraskha Sanhita, 2023, whereby the accused petitioner namely, Lucky Lagachu, has prayed for bail in connection with Spl.(P) Case No. 39/2025 (arising out of Dhakuakhana P.S. Case No. 16/2025), pending in the court of learned Special Judge (POCSO), Lakhimpur, North Lakhimpur.
3. The petitioner is stated to have been detained in custody since 05.03.2025 pursuant to his surrender.
4. The learned counsel for the petitioner submits that trial is in progress and so far, victim and informant has been examined and the same is confirmed by the prosecution as well as the learned counsel for the informant.
5. Considering the length of detention, he can be released on bail at this stage, subject to conditions.
6. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Spl.(P) Case No. 39/2025 (arising out of Dhakuakhana P.S. Case No. 16/2025), pending in the court of learned Special Judge (POCSO), Lakhimpur, North Lakhimpur, on furnishing bail bond of Rs.50,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court.
7. The direction for bail is further subject to the following conditions: (a) That the petitioner shall be available for trial; (b) That the petitioner shall not hamper or tamper with evidence; and (c) That the petitioner shall not try to influence any witnesses.

8. Violation or breach of any condition(s) shall entail cancellation of bail.
9. With the above observations, this bail petition stands allowed and
disposed of accordingly.
