The appellant, ICICI Lombard General Insurance Company Limited, is represented by its duly authorized official, namely, Mr. Bitopan Gogoi, Legal Manager. Mr. M. Talukdar, learned counsel, appears on behalf of the claimants and is present along with claimant No. 1, namely, Smti Menaka Devi. It is submitted that the total awarded amount is Rs. 23,53,000/- (Rupees twenty three lakhs fifty three thousand) only. After negotiation, both the parties have mutually agreed to settle the matter for an amount of Rs. 23,00,000/- (Rupees twenty three lakhs) only, out of which Rs. 11,76,500/- (Rupees eleven Page No.# 4/4 lakhs seventy six thousand five hundred) only has already been paid, and the balance amount Rs. 11,23,500/- (Rupees eleven lakhs twenty three thousand five hundred) only is agreed upon as a full and final settlement of the claim. Accordingly, the appellant/ICICI Lombard General Insurance Company Limited is hereby directed to deposit the balance amount of Rs. 11,23,500/- (Rupees eleven lakhs twenty three thousand five hundred) only before the learned MACT, Morigaon within 1 (one) month from the date of the order and the claimant No. 1, Smti Menaka Devi, is permitted to withdraw the same on behalf of the claimants on being proper verification and identification.
