1. Heard Mr. I.U Choudhury, learned counsel for the petitioner. Also heard Mr. R.J Baruah, learned Additional Public Prosecutor for the State of Assam.
2. This is an application filed U/S 483 of the BNSS, 2023 for grant of bail to the accused/petitioner namely Bahar Uddin @ Bahar, who was arrested on 18.05.2025 in connection with Sessions Case No. 172/2025 arising out of Badarpur P.S Case No. 34/2025 U/S 61(2)/103/238 of BNS, 2023.

3. Vide order dated 07.11.2025, status report was called for from the Ld. Trial Court .
4. Mr. I.U Choudhury, learned counsel for the petitioner has submitted copies of the orders dated 24.10.2025 and 15.11.2025 passed by the Ld. Court below which indicates that consideration of charge is yet to take place due to absence of one accused.
5. The T.C.R, as called for, has been received.
6. On perusal of the same as well as the charge-sheet, the case seems to be based on the statements of co-accused persons and besides that no material would be pointed out which can be said to be incriminating in nature as far as the present petitioner is concerned.
7. Having regard to the above, as well as law laid down in Tofan Singh V. State of Tamil Nadu reported in (2021) 4 SCC 1, the prayer for bail is allowed.
8. The above named petitioner shall be released on bail on furnishing a bail bond of Rs. 50,000/- with 2(two) local sureties of like amount to the satisfaction of the concerned Ld. Trial Court, in connection with the aforesaid case, provided that the petitioner shall cooperate with the investigation and shall not try to influence or intimidate the witnesses in any manner, either directly or indirectly, by himself or through any other person.
