CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI
------ For the Petitioner : Mr. M.M. Sharma, Advocate For the State
: Mrs. Anuradah Sahay, A.P.P. ------
2/18.09.2025 Heard learned counsel appearing on behalf of Petitioner and
learned counsel appearing on behalf of the State.
2. The petitioner is apprehending his arrest in connection with Jaridih P.S Case No. 155/2023, corresponding to G.R Case No.1258/2023, for the alleged offences registered under Sections 414,468/34 of Indian Penal Code, pending in the Court of learned A.C.J.M, Bermo at Tenughat, Bokaro.
3.
Learned counsel for the petitioner submits that the petitioner has moved before the court in ABA No. 2574 of 2024, which was dismissed as withdrawn by order dated 31.08.2024. He further submits that the present anticipatory bail application has been filed in the changed circumstance. He further submits that one of the co- accused Ajay Kewat has been granted anticipatory bail by the learned Session Judge in ABP No. 117 of 2025 after withdrawal of the anticipatory bail application by this petitioner.

submits that the petitioner is having criminal antecedent and one of the stolen motorcycles has been recovered from the house of the petitioner.
5. It transpires from the impugned order that the petitioner is having certain criminal antecedents, which has come in Para 60 of the case diary and one of the stolen motorcycle has been recovered from the house of the petitioner and considering that the learned Session Judge has rejected the anticipatory bail application of this petitioner and the co-accused, who has been granted anticipatory bail in ABP No. 117 of 2025 is concerned, his name has come on the confessional statement and considering that one motorcycle has been recovered from one Raju Nayak and another from this petitioner, the learned court has granted anticipatory bail. Thus, case of the petitioner is on different footing.
6. In view of the above, the case of this petitioner is not covered in light of the co-accused Ajay Kewat, who has been granted anticipatory bail by the learned Sessions Judge by order dated 7.3.2005, the petitioner is having the criminal antecedent, recovery of stolen motorcycle has been made from the house of the petitioner, I am not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, this petition is dismissed.
