Heard Mr. A.K. Gupta, learned Senior Counsel for the accused applicant. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State respondent. 2. This is an application filed under Section 483 of the BNSS, 2025, for grant of regular bail to the accused applicants in connection with Duliajan P.S. Case No.188/2025 registered under Section 105/61(2)(A) of BNS, 2025, read with Section 14/15 of the Assam Game and Betting Act, 1970. 3. The I/O has submitted a bail objection objecting to the grant of bail. The contentions of the I/O in the bail objection is co-relate with the other materials revealed by the investigation that the accused Raghuveer Yadav and his wife Savitri Yadav and Manoj Prasad Sah were the organizer of the gambling where various other persons including co-accused use to assemble and indulge in the gambling and on that unfortunate day, the husband of the informant had also come there for upon fear of police coming there, he ran through a dangerous road and died falling into a pit. His dead body was recovered a few days after the alleged offence. 4. All the petitioners were also arrested on 01.11.2025. The investigation is reveals sufficient incriminating materials against the petitioners and supported the basic contention of the prosecution at this stage that they were organizers of the gambling activities. 5. Despite the adverse materials against the petitioners, I take note of the fact that there seems to be reasonably good progress in the investigation and several of the co-accused have also granted bail by this Court. 6.
Accordingly, in the given facts and circumstances, the accused person herein is allowed to go on bail of Rs. 30,000/- each with one surety of like amount each to the satisfaction of the concerned learned Court and subject to the following conditions that:- (i) That the accused person shall co-operate with the remaining investigation. (ii) That the accused shall not hamper or tamper with evidence. (iii) they shall not misuse the liberty to commit any illegal activities, including any activities prohibited by the Assam Games and Batting Act, 1970. 7. In case of violation of any bail conditions, the prosecution shall be at liberty to move a suitable application for cancellation of the bail application of the petitioner. 8.
