(Oral) Petitioner herein, who is disabled to the extent of 50% and presently working as Head Teacher at GPS Gatiyanu, District Chamba, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide her pending representation (Annexure P-2), whereby she has prayed for her transfer from present place of posting to one of the stations, as detailed in the representation. 2. Though prior to the filing of the petition at hand, petitioner had requested the respondents to adjust her at Ghalti, but before any order could be passed on the representation of the petitioner, afore station was filled up, as such, petitioner is compelled to approach this Court in the instant proceedings. 3. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. Vishal Panwar, learned Additional Advocate General. Mr. Panwar, fairly states that representation, if any, filed by the petitioner shall be considered and decided expeditiously in accordance with law. 4. Though in the case at hand, petitioner has not completed normal tenure at present place of posting, but on account of being disabled to the extent of 50%, she is entitled to transfer to a convenient station, in terms of Clause 5.3 of the Transfer Policy, which enables disabled employee to seek transfer to a convenient station. Since station given in earlier representation, which is stated to be lying vacant, is filled up, coupled with the fact that one Mr. Sanjay Pathania, Head Teacher at GPS Bagodi, Education Block Kiani, District Chamba, Himachal Pradesh, is ready and willing for mutual transfer, this Court sees no impediment in disposing of the present petition reserving liberty to the petitioner to file fresh representation within a period of two days, seeking therein transfer on mutual basis, which shall be decided by the competent authority within two weeks from today. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an 2 opportunity of being heard to the petitioner and pass appropriate orders taking note of Clause 5.3 of Transfer Policy.
