1. Heard Mr. H. Das, learned counsel for the petitioner. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam.
2. This application has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in respect of C.R. Case No.2066/2018, pending in the Court of the learned Judicial Magistrate First Class, Kamrup (Metro) at Guwahati, filed under Section 138 of the Negotiable Instrument Act, 1881.
3. The petitioner is an accused before the Trial Court, the Trial Court directed the issuance of non-bailable warrant of arrest against the present petitioner.
4. The learned counsel for the petitioner submits that he is interested in facing the trial and on earlier occasions he did not receive any summons from the Trial Court.
5. I have considered the submissions made by learned counsel for both the sides.
6. Since the petitioner is interested in facing the Trial, he deserves to be given one opportunity to appear and fact the trial.
7. Therefore, the bail application of the petitioner is allowed.
8. It is hereby directed that within the next 15 (fifteen) days, the petitioner Hapijul Ali shall appear before the learned Judicial Magistrate First Class, Kamrup (M) at Guwahati in respect of C.R. Case No.2066/2018 and on his appearance, he shall be released on bail of Rs.20,000/- with a surety of like amount to the satisfaction of the learned Judicial Magistrate First Class, Kamrup (M).
9. With the aforesaid direction, this Criminal Petition stands disposed of.
