JUSTICE PRANJAL DAS O R D E R 18.12.2025 Heard Mr. HRA Choudhury, the learned counsel for the petitioner and also heard Mr. K. Baishya, the learned Additional Public Prosecutor appearing on behalf of State respondent. 2. This is an application under Section 482 of the BNSS, 2023 for grant of pre-arrest bail to the petitioners, namely; Md. Shamim Ahmed @ Samim Ahmed and Asar uddin @ Abdul Asar, in connection with Karimganj P.S Case No. 409/2025 registered under Sections 189(2)/ 126(2)/109/ 324(4)/296/115(2)/351(2) of BNS, 2023. 3. The allegation, as per the FIR, is that the accused No. 1 named Sams Uddin attempted to kill the informant by strangulation, while other accused persons demolished his auto-rickshaw. 3. The petitioners were granted interim bail on 18.11.2025. The case diary has been received. The petitioners have appeared and their statements have been recorded. It appears that the incident arose out of altercation with regard to some bandh on that day and where after, the accused persons allegedly attacked and injured him and also damaged his auto vehicle. 4. I perused the injury report, which indicates that simple injury with blunt object. 5. In the given circumstances and also since the petitioners have rendered Page No.# 3/3 his cooperation; therefore, I am not inclined to cancel his interim bail. Accordingly, the interim bail granted to the aforesaid petitioners vide order dated 18.11.2025 is hereby made absolute, subject, of course, to the following conditions:- (i) they shall continue rendering co-operation with the investigation. (ii) They shall not hamper or tamper with the evidence. (iii) They shall not commit any illegal activities. 6. Violation of any bail condition will entail cancellation of the bail. 7. Accordingly, this instant anticipatory bail application stands allowed and disposed of. 8. Send back the case diary. JUDGE Comparing Assistant
